Court Sends GOP Spinners Into Overdrive

Last week, conservatives of all stripes were handed a great big steaming pile of disappointment when the Supreme Court voted 5-4 that the Patient Protection and Affordable Care Act (aka "Obamacare") was constitutional.

In particular, the Supremes upheld the "individual mandate," which requires most people to buy insurance or pay a penalty.

The reaction was pretty much what you'd expect from the unhinged right, for whom Obama Derangement Syndrome is the new normal. There were calls for the impeachment of Chief Justice John Roberts. Someone briefly changed Roberts' Wikipedia page to brand him "Chief Traitor of the United States."

Former Michigan GOP spokesperson Matt Davis went even further: "[H]as the Republic all but ceased to exist?" he wrote on the Michigan Capitol blog. "If so, then is armed rebellion today justified?" When pressed for clarification, he refused to back down: "You can't have people walking with lattes and signs and think the object of your opposition is going to take you seriously. Armed rebellion is the end point of that physical confrontation."

Later, however, he did amend his remarks to say he'd "take out the part about armed rebellion." Whew. Good thing. Else someone might think the right wing was made up of, you know, radical traitors.

Some conservatives did paw through the wreckage of their hopes for a black eye for the president, trying to salvage something. They found it, or so they thought, in Chief Justice Roberts' opinion that, while the mandate could not be upheld as an exercise of the Constitution's Commerce Clause, it did fall within their power to levy and collect taxes, because of the penalty provision. They seized upon the idea of a "tax" and began waving it about with glee.

"The biggest tax increase in the history of the world!" trumpeted Rush Limbaugh. (Wrong, as usual. As noted by numerous sources, even if you accept it as a tax, it comes in 10th in U.S. history, behind Bush the Elder's 1990 tax increase and far behind that of Saint Ronnie Reagan in 1992.)

But calling the mandate a tax increase, while it handed the Republicans in Congress a new talking point, handed their presidential candidate a ticking time bomb. Mitt Romney's health care plan in Massachusetts, which he's on video touting as a model for the country, contained a nearly identical health insurance mandate. But Romney's insisting he didn't raise taxes in Massachusetts.

So, when campaign spokesman Eric Fehnstrom (who gave us the notorious "Etch A Sketch" quote) told NBC that Mitt "disagreed with the ruling of the court. He agreed with the dissent written by Justice Scalia, which very clearly stated that the mandate was not a tax," he really didn't have any choice.

Or did he? If you're Mitt Romney, you always have a choice, if you regard directly contradicting what you just said as a choice. Wednesday, Mitt raised that Etch A Sketch above his head and shook with all his might to try to wipe out his campaign's stated position of the day before.

"While I agreed with the dissent," Romney said, "that's taken over by the fact that the majority of the court said it is a tax, and therefore it is a tax. They have spoken. There is no way around that."

Now, one could view this not as a contradiction, but as a nuanced statement that Romney still doesn't think it's a tax, but that it's legally one now, so we have to live with that. But that hands Romney another set of problems:

First, Republicans don't do nuance. Nuance is what they beat John Kerry to death with in 2004. The second problem is similar: The rubes, racists and rageaholics of the Republican base hate the president so much, they will completely disregard anything Romney says or does and pull the lever for him anyway.

Romney could kill a kitten with a hammer at the podium during a campaign stop and by nightfall, right-wing bloggers, Republican talk radio and Fox News would be flooded with pundits insisting the kitten had it coming, and it'd be an article of faith among the Rabid Right by the weekend.

But to independents and undecideds, saying, as Romney did in a CBS interview, "It wasn't a tax when I did it, but it is when it's in Obamacare," makes you look like a weasel. Romney is just that, of course, but this particular act of weaseltude may be the one he can't wiggle away from.

Pick your own poison: A huge tax increase on the middle class or an unconstitutional penalty.

Yes it has some nifty giveaways but it will still cost American's jobs and seniors will have trouble finding care but at least Dusty gets to keep his auto insurance

bigD, I huge tax increase? In reality it's much smaller than the tax hike Reagan signed into law, and way down the list of tax increases by size.

The fact is that the tax on those who want a free ride for health care will affect only a tiny portion of the country. Much more important is that we are finally taking concrete steps to get health care costs under control before they bankrupt all of us, while assuring care for those who need it.

BTW - The tax is largely unenforceable. The only way the IRS can collect from an unwilling taxpayer is to attach his or her tax refund. Doesn't sound very draconian.

Speaking last week at a fundraiser in Wheeling, W.Va., Boehner was surprisingly candid in his characterization of Romney’s candidacy when asked, in a question-and-answer session: “Can you make me love Mitt Romney?” “No,” he answered, as first reported by Roll Call. “Listen, we’re just politicians. I wasn’t elected to play God. The American people probably aren’t going to fall in love with Mitt Romney.” He added that the presumptive Republican nominee had “some friends, relatives, and fellow Mormons… some people that are going to vote for him,” but suggested that at the end of the day, Republicans would be voting against President Obama rather than for Romney.

Real ringing endorsement from the party leadership. Meanwhile, the Rethuglicans continue to outrage and energize key sections of the electorate (women, Latinos) and the economy continues to show improvement. Slow, to be sure, but the 'thugs aren't going to win any love by dismissing every peace of good news and pulling for America to fail.

And I do wish that the Pilot would consider someone else, other than Dusty,to write the "left's" views. Andrew Soboerio (question on spelling last name) was great. So many resist thinking about how big of a mess this country was in under George W.

Now the whole world is falling apart economically and environmentally. It's all Obama's fault! So many forget that we have a God given decree to help the less fortunate amongst us, ergo, Romney considers millionaires and billionaires to be less fortunate when the price of jet fuel goes up and they have no deduction to cover the expense.

So many coupon millionaires living in Poorer County...amazing!

So what is wrong with Affordable Health Care where the insurance industry is more concerned with the bottom line and dividends to stock holders than a child who may be dying due to "a pre-existing condition".

Several years ago, I had a heart cath at First Health. Blue Cross and Shield of NC denied payment because ~ you guessed it! A pre-existing condition! The cardiologist found less than 5% plaque and no heart disease. It took over six months and several letters, trips to my family physicians office, volumes of faxes of medical histories, and a threat to file suit before BC&BS capitulated and payed the 80%.

Insurance company personnel are instructed to decline payment the first and second time paper work before payment is even considered. Then they check for clerical errors, punctuation, completed forms, etc. until it comes time to take them to court after months of haggling. Now your credit history is tarnished by a bad debt because they are not to eager to correct their errors. Now that's another several months to sort out your valid claim and try to correct their problems with payment. People should be up in arms with the insurance industry; who have bought and paid for your representatives votes and junkets to exotic places on your child's health.

Time to focus on the real villains in these matters of concern.

I wish there was some way to determine who actually couldn't afford HI vs those who chose to spend their funds on other non neccesity things. I phones, internet casinos, nice car, fancy duds, fancy doo's, smokes, alcohol, etc. I know, I should be sent off for even thinking such a person exists.

I asked former President Bill Clinton if he thought he got bad advice on regulating complex financial instruments known as derivatives from his former Treasury Secretaries, Robert Rubin and Larry Summers. He acknowledged that he was wrong to take the advice of those advising him against regulating derivatives.
“On derivatives, yeah I think they were wrong and I think I was wrong to take [their advice] because the argument on derivatives was that these things are expensive and sophisticated and only a handful of investors will buy them and they don’t need any extra protection, and any extra transparency. The money they’re putting up guarantees them transparency,” Clinton told me. “And the flaw in that argument,” Clinton added, “was that first of all sometimes people with a lot of money make stupid decisions and make it without transparency.”

Dusty...too bad I didn't get to see you driving the 'stang while out cruising in my 340 formula S fastback Cuda that I sold after 45 years of ownership. Quarter with a mild chunk was 14 flat at a hundred according to Kinston Drag Strip...on street tires and through the mufflers. Sweet ride but I couldn't work on it any more what with tri-focals, bad knees, and arthritis in the hands.

The answer is no. His knowledge of economics apparently matched his knowledge of Bill Buckley. "Mr. Buckley" was an obvious plant, who came here soley (a) to act smart, and (b) spew filth. He certainly accomplished the latter, and failed miserably at the former. It now appears that all of his posts have been removed which, while understandable, is somewhat unfortunate because the posts reveal what left-wing radicals are willing to do to post false information and malign those who disagree with them...the old "scorched earth" approach. This could be a teachable moment for those who care to pay attention. Cheers!
