Tickets Are Mishandled

I am writing to agree with the letter by Larry Schuel (Feb. 27) chastising the Pinehurst police for the zeal with which they ­pursue, what they must feel is their duty, to hand out speeding tickets to the many aging Mario Andrettis who are apparently racing around the Pinehurst area endangering its citizenry.

Even more appalling is the fact that if you are one of those unfortunates on the receiving end of one of those tickets, you will be inundated for days ­afterward with letters from ambulance-chasing lawyers who are eager to help you fight the ticket for anywhere between $200-$350.

In every other state that I have lived, if you received a speeding ticket, you could mail in your ticket with a pleading of guilty, along with your payment of the fine, and the issue was over. Only here, in the grand state of North Carolina, are you forced to participate in the state-condoned ripoff by the legal profession, willingly aided and abetted by the Pinehurst Police Department.

Ross you are the one that needs to grow up. You are right everyone has a right to complain but they should be correct when they do including you. It is not about the money do your research before making such statements. From the court cost towns get a $5.00 service fee for each citation this is available on the NC courts web site. At that rate it would require an officer to write 6000-7000 citations just to make the town back what the officer makes in a year and even you have to admit that no officer writes that many. Mrs. Stipe also do your research in most cases such as infractions you can just send it in with the payment (read the back of the citation!) if it is a mandatory court appearance then you are accused of a misdemeanor which is a crime not just a traffic violation. Yes I agree lawyers will send a million letters, but it is your choice to hire one, it is not required. I have to respect the Pinehurst Police for writing the citations (even to Pinehurst citizens) and not looking the other way it shows they are professional and non-biased. If you don’t want a ticket, the best thing to do is obey the law.

Again Ross do your homework that is a blog not a legit source the author doesn’t even show his/her sources just makes statements to get people riled up. Go look at NC courts http://www.nccourts.org/Courts/Trial/Documents/court_costs_chart-2010-criminal.pdf and you will get the break down. I am not saying its not a lot of money what I am saying is the municipalities are not making money off officers writing tickets. And yes I have broken laws and I have received tickets, the difference is I admit it because I did it and I don’t blame the officers for doing their job. Every time I received a ticket the officer was always professional. It also did not take me long to learn the cause of the tickets was me, so I changed my behavior and haven’t had a ticket in years. So take responsibility, if you do it don’t blame others for it! I think its funny that when people write in the opinion section and whine about officers doing what they are paid to do, they never write what they were cited for. I guess they are looking for sympathy without wanting the reader to know just how serious a violation they commited.

saturn5 - You need to read my posts a bit closer. I am wondering when I said I blamed the officer for a ticket! What frustrates me is the system. It is a multi billion dollar "industry" and I am certain you would admit that!

Google it - there are hundreds of sources.

In every other state that I have lived, if you received a speeding ticket, you could mail in your ticket with a pleading of guilty, along with your payment of the fine, and the issue was over.

Until you get your next bill from the insurance company. But hey, if you don't mind your rates going up over a ticket that you paid off without thinking, it's no skin off my nose. Like the line from the movie Airplane: Chump don't want no help, chump don't get no help.

Actually your stats are still wrong, at least on population, as Pinehurst is now larger (population wise) then Southern Pines. Also if you go to SPPDs web site they have 31 officers and Pinehurst has 24. as far as the number of citations i dont have any idea. the population can be checked on http://www.moorecountync.gov/index.php/en/demographics Pinehurst 13,124 Southern Pines 12,334.

the average number of sworn officers across the US is 3 per 1000 residents. by that PH should have 39 officers and SP should have 36 both agencies are understaffed. Pinehurst has the 2 largest employers in Moore county (First Health and Pinehurst Inc) and over 150,000 cars a day traveling its roadways. again both agencies are understaffed. the reason pinehurst enjoys such a low crime rate is the officers dillegence and hard work. I still would like to see where you got your numbers on tickets, Im not doubting you i just would like to see them. BTW if needed I can produce my stats.

The number of cars is on the ncdot website. And I said 3 not 3.5 and the current FBI stats show thatso does citi-data.com. either way understaffed. I agree there are numerous reasons why the crime rate is low but without a doubt its partially the supurb job the pd does

How else are they going to pay for all of the Chargers they need for the hundreds of high speed chases each month in Pinehurst? Those seniors must get those Cadillacs up to at least 37 mph some days!

Three things that really make me angry:

  1. A $50 fine and $150 court costs. While I realize there is a processing cost, I still have no idea how this is justified.
  2. Why a lawyer can almost always get the charge reduced to a "non" moving violation. Of course - the fine and costs never change.
  3. Why people are not more outraged by this.

I wish the police were just as zealous to write tickets for those who drive 15+ MPH under the speed limit for impeding traffic…but I guess it’s just no fun to zoom down the highway, to pull someone going too slow. They have a bad case of selective enforcement. Keep up or turn your license in grandpa.

you may very well need a lawyer, North Carolina takes part in the Drivers License Compact (DLC) which requires member states to exchange traffic violation information back to the state in which the motorist receiving the ticket is licensed. In other words if you gt a ticket in Virginia and you are going more than 15 miles over the limit, NC can take your license http://www.ncdot.org/dmv/driver_services/drivingpublic/suspensions.html

You do of course realize the bottom line is if you were driving the speed limit you would not have received a ticket in the first place. People, grow up, if you don't want to pay the fine, don't speed. As for the "chargers" look around, almost every town in Moore County has them. I appreciate any police force actually doing their jobs.

It's not always about what you actually did. I went through a yellow light at 35 in a 35 because there was still gravel on the road after the snow melted. The officer cited me for going through a red light (the last I could see it before my roof cut off my view, it was yellow), and for reckless driving. Had I attempted to stop, I would have slid through the intersection on that gravel. She was also very unprofessional, insecure, and bullying. When the DA offered to reduce the charge, I said "no, thanks, I'm fighting it". When he read the name of the citing officer, he said "oh, her" and ripped up the ticket. How many others accepted her false charges without fighting? A footnote to the case: a year later, she was killed in her own home, no sign of struggle or forced entry. She knew whoever did it and let them in. All the officers on the force said "she was the nicest person. We have no idea who would want to do something so terrible". As far as I know, they never did find out who did it.

Dodge Chargers ~ think in terms of Sam's Club for volumn discount...the more one buys the cheeper the price. Next year it may be Cheverolet Impala's or Ford Focus with gas going up or maybe peddle power. My goodness some of them need more exercise.

How about tailgaters not at sporting events. In the last week I've had five young ladies who think getting closer is better while driving a car. On two occasions in Pinehurst I couldn't see the front of the car, just the glare of the headlights. It seems there needs to be stepped up enforcement on the most traveled roads in P'hurst.

BTW: I was driving the posted speedlimit. It seems the Southern laid back approach to driving and not getting in a hurry no longer applies to the Southern charm of years gone by...try driving the speed limit if you want to tick someone on a mission from God off; or, try leaving a few minutes early to avoid getting cited for a motor vehicle law violation. Works every time.

if you really want to make a tailgater mad, slow down. Toda try driving 211 between 7:30 and 8:00 am I have seen people come right up on your bumper and keep right on putting on their makeup or eating breakfast

I agree. there are too many idiots on 211 any time of day that don't seem to have a care in the world or the care for the other driver(s). Maybe they need to take an alternate route from Seven Lakes to Pinehurst other than highway 211. You can leave early to try to miss the slow poke but then there is another one or a school bus.

I see most young people are the tailgaters, apparently never rear-ended someone. Try driving to Sandhills Community College any hour of the morning before classes. Or late in the evening before night classes, you will get gated by someone who has to look under the top of the steering wheel to see to drive. My wife and I were on our way to Cox's funeral home for a viewing when a duelly towing a long trailer pulled up on my bumper as I was moving to the turn lane blowing his horn and flashing his lights to get out of his way. He was running probably 70 since I never saw him until I was in the left lane getting ready to move to the turn off. I locked it down, he passed on the my right only inches from my right door rear view mirror. I pulled over hoping he would stop...no such luck.

If citizen Joe Blow went to court,with a attorney, was cited for going 45 in a 35, then then citizen Lacretia Doe went for the same offense, same speed, without an attorney what would each judgement be? I have always wondered this? If the judge sees that citizen Joe Blow is paying one of his legal buddies, would the judgement be less for Joe Blow? One of you attorneys help me out with this one!

I agree with the posts that state how simple it is to avoid all the court costs, fines, points on your license, increased insurance rates, etc. - OBEY THE LAW!!!! I am not claiming to have never gone over the speed limit - I have gotten two tickets for exactly that in the 40+ years I have been driving. I was wrong both times, paid my fine, took my defensive driving course (in some states, one can do that and not get insurance points) and went on my way. But if and when one does disregard the law and gets caught, they shouldn't blame the officer(s) for doing their job. These same people will complain if someone is speeding down their street putting them or others in danger. We all need to abide by the same laws - they are not written for "the other guy" and not me!

Traffic lawyers get a quota of free passes (this was actually told to me by a lawyer handling my case - not coming to an absolute stop on a country road void of any traffic for miles at 11 pm).

The system is flawed - plain and simple!

I too have often wondered about this. I called a lawyer's office once about a speeding ticket, the lady answering the phone (this was my initial call on the matter, she hadn't even talked to the attorney yet)told me it would be reduced to improper equipment, I said "so thats what you think?". She said, no, thats what it will be. It doesn't smell right.

Its amazing, we frequently hear people whining about overpaid doctors but I never hear the same about lawyers. It must be very lucrative based on the volume of mail when one gets a ticket.

I agree with the poster who talked about the option of mailing in your fine, pleading guilty when you know full well you are guilty. There should be no manipulation by attorneys. When you can pay to make a situation "go away" where is the influence to change your behavior. I guess if you are poor and cannot afford an attorney you get screwed. Finally an actual instance where the monied have an unfair advantage over the poor.

I got a ticket in Alabama one time, drove all the way from NC to fight it because I knew I wasn't going over the speed limit, I sat in the zoo of a courtroom to have some man walk up to me and ask why I was there, I showed him my ticket, he took it and brought it back a few min later with reduced charges, I paid it and left, my insurance did not go up

fugitiveguy => your thoughts are considered should one who was unaware of their speed only to be ticketed for going faster than the posted speedlimit. I don't think it is as much about hiring an attorney to manipulate the court for a reduced charge rather than to save a person an increase in insurance primiums over several years. Also keep in mind that three tickets over the posted speedlimit in 12 months, one has to walk or buy a "liquor syckel"... a small fee to an attorney may be well justified considering the cost of automobile insurance ripoffs.

My part of Pinehurst was just fine when the speed limit was 35. So what did the police do to create trouble & money? Lowered it to 25!! For absolutely no reason. I feel ridiculous driving 25, may as well pop it in neutral and save some gas. Now the PPD lurks in the bushes, when they're not too busy "protecting" the gas station, to catch you doing 35. Probably not a coincidence that every other house around here has a For Sale sign...

Do your homework the residents asked the village council to lower the speed to 25. Go to some of the council meetings and you will find other residents asking that their neighborhoods be lowered to 25 also.

I don't want to cough up any money I don't have to. Not to the court, not to an attorney, not to the insurance company. Its much easier to just drive the speed limit plus 4-5. No traffic tickets in 24years. Cruise control is one of the greatest inventions known to man, also the tv remote is pretty cool too.

As a tax paying citizen of Pinehurst I want to thank our officers for doing a great job. To everyone who thinks Pinehurst has no crime, open your eyes. Times are changing and Pinehurst is not the sleepy little town it once was. It is proven that the mere presence of officers in an area reduce the crime in that area. Go figure, what the men and women of the Pinehurst police Department are doing must be working because Pinehurst still has one of the lowest crime rates in the county. Let me ask you all a question. Has no one ever gotten a ticket from any other law enforcement officer (SHP, Aberdeen, So. Pines, ect...) Last check Pinehurst doesn't even have a traffic team unlike other towns in the county. Check those agencies numbers and see where Pinehurst ranks as far as citations. Bottom line, down break the law and you don't have to worry about being harrassed by the lawyers. Just think of the letters you get as sales papers. Are they really any different than what you get from a business. They're offering a service or item for a price!

There is crime, but VERY little to no violent crime. We still have the classic problem of officers that are bored and will take out their aggression on people that don't deserve it. Again, its not the fact that they give out tickets to those who are speeding, ect. it's the way they handle it. A good deal of these officers are over zealous and aggressive in the way they deal with the public. Being stopped for walking around your own neighborhood at night, or going 4 mph over the speed limit does not deserve a shake down and rude behavior, especially when you are treating the officer with respect and acting calmly....but I have had that happen to me an many others I know, and it is a problem that is specific to Pinehurst.

There are always a few exceptions to the rule, but generally if one obeys the law the police usually leave you alone. If you stay as close to the speed limit as you can, pay attention, and not drive like a jerk, you won't get a ticket or create animosity on the roads. That means if you are going to fast, SLOW DOWN, or if you are going to slow, SPEED UP or get out of the way. It's all about respect for each other, we all have to use the roads. The police are in a bad position, if they don't ticket speeders and there is an accident with speeding as a factor, they get raked over the coals. If they give to many speeding tickets, they get raked over the coals. I for one, would rather see to many speeding tickets, it reduces the chances of that one jerk that slips through the cracks and kills someone on the roads.

AND YOU DO NOT HAVE TO REPLY TO THE LAWYER LETTERS YOU CAN HAPPILY TAKE YOURSELF TO THE COURTHOUSE AND GLADLY PAY IT OFF. IF YOU DO IT THAT WAY YOU WILL GET PIONTS AND YOUR INSURANCE GO UP.
