Three Shot, Injured in Robbery of Convenience Store

Moore County sheriff’s deputies have three suspects in custody and are searching for a fourth in connection with an armed robbery and shooting that happened Monday night at a convenience store near Vass.
Two of the suspects are in jail and a third is hospitalized after the robbery that happened just before just before 10:30 p.m. Monday at the Exxon Short Stop Food Mart at the intersection of U.S. 1 at Camp Easter Road in Lakeview.
“He is ducking us,” Sheriff Lane Carter said of the fourth suspect. “He knows we are looking for him, and we will find him.”
The store clerk, Grace Kelly, 75, her husband, Angus Kelly, 78, also were shot during the robbery.
Angus Kelly arrived at the convenience store to pick up his wife and came upon the robbery. He got a shotgun from his vehicle and fired a shot through the store window, according to a Sheriff’s Office report. Gunfire was exchanged, and Kelly was shot in the torso. His wife was hit in the arm, and Williams was a shot in the face.
Grace Kelly was treated and released at First Health Moore Regional Hospital. Her husband was taken to UNC Hospitals Chapel Hill, where he has undergone surgery. He was listed in serious condition Tuesday afternoon.
The Kellys grandson, Chris, said he was home listening to the police scanner when deputies were dispatched to the store. He said he tried to call his grandmother to tell her what was going on and to urge her to be careful, but he was unable to reach her for several minutes. He kept calling until she answered.
She told him that everything was fine and not to worry, he said.
“Then I got a call from somebody who said they heard it was Grace who had been shot,” Chris Kelly said. “I told them they didn’t know what they were taking about because I just talked to her. I guess she wouldn’t tell me (she’d been shot) because he didn’t want to to get worried.”
Sheriff Lane Carter has known the Kellys for several years. He was on scene after Angus Kelly had been airlifted to the hospital.
“They handled the situation pretty well,” Carter said. “It was bad enough but it could have been a lot worse.”
After a two-hour search of the area, two of the three suspects identified from the store video were arrested.
Randy Joel Williams, 17, of Southern Pines, was found in a wooded area about a half mile from the scene. Williams had sustained a gunshot wound to the face. He was transported to FirstHealth Moore Regional Hospital, where he underwent surgery and is currently listed in critical condition.
Demarcus James Dennison, 18, of Polkton, was also found in the wooded area with Williams. Investigators later arrested Leroy Richard Medley Jr., 20, of Southern Pines.
Dennison and Medley have each been charged with two counts of robbery with a dangerous weapon, two counts of assault with a deadly weapon with intent to kill inflicting serious injury and first-degree kidnapping. Both are being held on under a $250,000 secure bonds. Their first court appearance is scheduled for July 15 in Moore County District Court.
Captain Richard Talbert of the Moore County Sheriff's Department said the identity of the fourth suspect is known. Police were believed to be searching for him in the Southern Pines area Tuesday
According to the incident report, a hispanic male told deputies he was inside the store with his baby when two black men entered the store. One was carrying a handgun, and the other had a shotgun. He and his baby got on the floor and told one of the suspects to take whatever he wanted. The suspect took his wallet.
He then heard a gunshot, and the black male wearing a white shirt grabbed his face. He heard another gunshot and notice that the glass from the front door of the store had shattered and went everywhere. He said it appeared the man holding his face appeared to have been shot by an elderly man in the parking lot who was standing next to a jeep.
Two men, the one who had been shot, and another wearing a red shirt, fled the store while a white car in the parking lot drove away.
Talbert said sheriff’s deputies will be in contact with other local law enforcement agencies to determine if the suspects may have been responsible for several other armed robberies in the area.
The most recent of which happened Saturday when gunmen robbed the Hardee’s in Aberdeen. That robbery was captured on surveillance video. Deputy Chief Jim Foster of the Aberdeen Police said the video from that incident has been taken to Carthage.
On Monday, Foster described the suspects in the Hardee’s armed robbery as being black males. One was wearing a red shirt and another had on a white shirt.
“We are pretty sure they are the same guys,” Carter said. “We haven’t been able to connect that dot yet, but we will.”

At least we know that this was not another crime committed by those darn visiting golfers, or someone trying to open a Bed and Breakfast in Pinehurst, of all places. Mr. Kelly should have had buckshot instead of birdshot. I hope the Kellys get well soon.

Dirty rotten low-life thugs !! WTH ever happened to getting a job during the summer after highschool ?? They can conspire to commit armed robbery, but can't put all that effort towards trying to make a decent honest life ?? I suppose it's no wonder since society in general has dissolved into thieving teenaged dropouts that were raised in single parent, lived off of foodstamps and welfare, don't-know-who-baby's-daddy-is households. At 17 & 18 they may already be baby's daddy themselves.....and then go off to spend the rest of their lives in prison to start the cycle all over again.

It does not surprise me that these guy's are from Southern Pines. Every time I read the paper there seems to be a lot of crime in the big SP. Shootings on Shaw Ave, Gains St, New projects, Old projects. Break-ins all over the place, businesses and homes. A lot of the people always comment about "Little Ole Aberdeen", as if its the only place crime happens in this county. There is a serious problem with crime everywhere. People should call the non-emergency number to there local police dept. and thank them for the services they provide and ask what you can do to help, instead of bashing them every chance you get.

I am so glad Mr. Kelly came when he did or who knows what might have happened? I am very sorry the Kellys were injured, though, and wish them a full recovery. Whoever says there's no serious crime in Moore County just need take a look at something like this. You hear of more and more convenience stores being robbed, the Hardy's from the other night, and then there's the hotels. Where are the parents of these thugs? Probably off partying somewhere and these young criminals live with Grandma who they do not respect. What a vicious cycle. Hope they see the inside of a prison for a long, long time.

This is such a sad situation. I hope Mr Kelly and Gracey have a speedy recovery. I worked with her for years and have known her and him since I was like 8 and I am old now. I am still numb by this all. Normally there is a Moore Country Sheriff up at that store at 10:30 until the clerk leaves it has been like that since at least 1992 and on my way down the road even to last week there is normally one there. Gracey always hated that shift due to fear of robbery.

My prayers go to the Kellys who were defending themselves. We see this all the time. It is a vicious cycle. Our prisons are overflowing with the same type of criminal. The root of the problem is in the home, and we all know what is happening. I think in the future, when we're all dead and gone, there will be a time when pathetic, worthless people who care nothing for themselves, or no one else, will "not be allowed" to have children. Maybe this is a RARE instance when one of these thugs had a parent that was good and tried hard to raise a good child, but how much do you want to bet on that??

i hate to bring race into this, but can you imagine what would happen if 4 young white guys planned an armed robbery on a store clerk who was an 80 year old black woman? i would bet money it would be classified as a "hate crime" - but because the shoe is on the other foot, it will simply be coincidental, and anyone who questions it will be called racist...

Bflat ~ me, too. I absolutely know that too many times, the true victim is punished. Who is to say that, as some remarked "Mr Kelly had better aim" it would relieve the taxpayers of this criminal's care & upkeep, that it wouldn't result in his being charged with this thug's death ? Or even if these are the same perps that have hit others here lately, that they wouldn't have just robbed her and left with no exchange of gunfire if they had not challenged ? Exercising 2nd amendment rights doesn't always mean that you are protected under the law. I hope the Kellys a speedy recovery and the least amount of grief possible dealing with the fallout that will surely follow this tragedy.

I agree Chuck- remember just a few weeks ago we were talking about those tracks and the trains - I have known these people all my life and I have never heard either of them say a bad word to any one... I think Gracie has worked at that store most of my life and a majority of hers...so now this is what they have to look forward to... I, too, will be interested in how this is handled and will be the first one to raise cain if I feel it is unfair....We need to pray for Genes recovery.

I know Mr and Mrs Kelly very well and known them for 20+ some yrs. My neice and Nephew are their grandchildren. You go Angus (Gene) you are a hero to your wife and others. You are one tough man and always been a wonderful husband to Grace and Grace I saw you just this past Saturday and at my nephews house and was so nice to see you it has been a long time since I seen you and you are still the tough woman you have always been. I am praying for both of you. I hope thay get rid of these thugs to where we don't have to pay any of our money to keep them up in prision. It aint worth it. I was on my way back home from Angier Saturday night and came through So Pines and there was a robbery going on at Hardees then it got to be the same guys. They will spend a couple of years in prision then get out and do it again. This court system sucks. Hang in there Grace and Gene (Angus) we all love you.....

However, in reality, the creation of predator children like these didn’t begin in the home; these kids are the product of a culture that allows their children to be robbed, raped and exploited in order to point the finger at white people. I have known the Kellys since i was a little boy and both would literally give you the shirt off their back if you needed it. I wish you both a speedy recovery and gene specifically thank you for doing the right thing at the right moment if more people were like you id be willing to bet that there would be far less crime either by the bad guys thinking hey i might be shot or killed if i do something like this or by sheer volume we would eventually cripple and kill enough of them to at least catch little breaks while the bad guys retreat back into their rat holes to lick their wounds. as for the suspects you need to be thankful it was a load of number 8 rather than 00 buck. Mr Williams since im "not a good christian man" i can say with total clarity i hope you walk the earth with a red tiped cain the rest of your days as i am sure those little bity lead pellets did a great deal of damage to the eyes of a would be killer !!!!!!

Whether Angus lives or dies, or the guys get a slap on the wrist, he did exactly what he intended to do; protect the life of his wife.
All this guy was thinking of was his wife.
According to the news she is fine now. No matter what happens, she is fine and the incident is over.

@ RmeMP You are right. It would be called a hate crime. As a black activist, I will say: “it was a hate crime. Black kids like these kids are taught from birth that white people are responsible for everything bad that happens to black people. It would be the height of ignorance to believe that all this hate being taught would not translate into self hate rather than violence against whites. America is ignoring this problem in the same way they ignored the rise of Islamic Radicalism among young Muslims in the 1970s.
We are trying to warn America that the so called race problem is the biggest hoax ever perpetrated on the American people. However Race baiting by the press and civil rights leaders under their protection has become a wall impenetrable. Racism as a dividing force would not continue another single day in America without their complicity. eflat - sorry, but in my eyes the "incident" isn't over. We still have 2 people hospitalized and one criminal on the street. We (taxpayers) will be footing the bill for these thugs for a while - lawyers, jail, medical care etc. And what about Angus and Grace???? After their insurance or Medicare pays their part of the bill, who will pay the balance? I sure hope there is a "Victim's Fund" in Moore County or North Carolina to help these people pay those bills. And what about the other expenses? Transportation and lodging for Grace and other family members so they can be with Angus in Chapel Hill while he recovers. Lost wages for Grace and any other family members who stay with her thru this. Rent and utilities still need to be paid and now Grace isn't working. Maybe someone could set up a fund at a local bank to help these people out. I know I would be willing to donate something to help...any one else willing to pony up and help?

This is so sad, I visit this store all the time, Mrs Kelly is always nice to everyone and a hardworker, she did not deserve this. KUDOS to Mr Kelly for taking it into his own hands. Praying for a fast recovery!!

I too would've liked to see a couple of these punks killed or maimed, but to lay blame on the press is a joke. Responsibility starts at home period. There are bad parents of all stripes but the AA Community has become largely a woeful failure in that regard. So sad for the few who do manage to do the single parent rearing well. Until this Country gets on with a child development educational process, it will continue on a downward spiral.

Just talked talked to a friend who says WRAL TV 5 will be at the store for a live report at 11 tonight. They are willing to come and do a report on the Kellys. We are asking ALL to come out in support of the Kellys,
Gene & Gracie. We desperately need a HUGE turnout!!!!!!! Churches, friends, neighbors, we need everyone to show up for this. Help me call and spread the word to be there at 10:20-10:30. We really need a lot of help to pull this off!!!!!!"

I applaud Mr. Kelly for his efforts and wish him a speedy recovery. Someone said that Mr. Kelly had bad aim, he shot a punk in the face! Sounds like good aim to me. It's unfortunate that he didn't get the rest of them..., but his mission was accomplished, his wife's life was saved.
For the folks who insist on using racial epithets, grow up. Scum comes in all colors.
For those who complain about our having to pay to house these criminals, that is precisely why we have prisons. These worthless beings need to spend the rest of their pathetic lives behind bars, constantly looking over their shoulders. If needed, we could consider releasing a non-violent offender or two to make room for these sub-humans.
Finally, in my opinion, the Moore County DA (Maureen Krueger) really needs to be voted out of office. We don't need to slap so many people on the wrists. We need to actually PUNISH people. If punishment were given, we might not see the same people in the courts over and over again.

I can't believe that this is happening in moore co. I agree that it starts at home too. I believe that parents think that just because a child has reached 17 or 18 that they do not need parenting anymore. I think that at that age they need it even more. I think it is just going to get worse too. I don't know if anyone else has noticed it but there is graffiti all over vass. Who would have ever thought that would happen here. I think that if we don't get a handle on it now we are going to end up like spring lake and fayetteville. I don't want to live there do you. I love Moore Co. I think this is the best place to raise your kids. I just hope it stays that way.

Thanks to the SHP, why didn't we get the secret chopper out for the Hardee's robbery and maybe they would have been caught over the week-end?
For those racial commentators, thugs do come in all colors, parenting can only do so much, the courts should keep these thugs where they belong and keep the influences off the streets and where they belong-behind bars. Change the laws, rules or whataever it takes. I'm ready for a safer community. Make it happen! One rotten apple spoils the whole bunch or didn't you learn that as a child...

My heart goes out to all the victims of this tragic accident. To the Kelly's I pray for your good health and speedy recovery. To Williams and your family I hope you will recover as well and I hold you and your family in my prayers as well. Everyone is always qick to point a finger, but at the same no one is ready to try to find a solution for the problem. African American was brought to this country and was force to do others dirty work. When they wanted better they where killed just from trying to make it to a better life. Then everyone was suppose to be treated equal, yet today's society make it hard for many African American to finish school. Growing up in Southern Pines I was a straight A student. Teachers in high school was so cruel, rude, and selfish I drop out. Even though i drop out of high school I continued with my education. I'm currently working on my masters degree. I also forgot to mention I grew up in a single parent home, but I did not give up. No matter how much many of the negative commentors try to put African Americans down there are many of us that strive for excellence. We are force to grow up in a society that is constantly putting us down, yet the problem starts at home. Sorry to inform, but the problems do not start in our homes. It starts when we are force to live with people that frown upon us when we walk down the street, it starts when they pass us in the parking lots they began to clinch their purses or hit the lock button on their cars a couple more times to make sure their cars are secure. Many African Americans can still hold their heads up high, but to some this is an insult. SO WHY SHOULD THEY BE FORCE TO RESPECT THOSE THAT DO NOT RESPECT THEM?

You should hold your head up high, but these men (1) already have criminal records and (2) are robbing from others (3) shot others (4) evidently have been doing this for sometime - in 3 counties. They have no respect for the people they robbed or injured and these people did absolutely nothing to them!

Yea I really do not think Race should be brought into play. But being we are giving a class on a Race issue I want to add my 2 cents. A little info in my Cultural Diversity classes I learned that the Black Americans in America are called Black Americans, True African Americans know what tribe they are really from Plus African Americans were sold to White Americans by their own people. There was also Whites that were sold as slaves to the Caribbean’s. Just had to add that before White people got blamed for the reason people being how they are now. I get sick of hearing people saying white people are always blaming the black man for crimes. And this is not true. When you are out there no matter the race and get caught committing a crime then you make your own self look like crap. One person can make the entire bunch look bad. For example you have priest raping kids so it makes people look at priest funny. And so forth that was just an example so do not bring the religion card out screaming we going to hell now.

All the racist was already here before. Wish it was a buckshot. To the mom ofthree, this issue do not give anyone permission to commit any types of crimes. All i was really trying to say is that instead of always saying bad parenting, single parent home, welfare, and ect is the blame because it not. Some of this people come from good christian homes, yet they chose to make the wrong descision. Look at it this way the boys was in the wrong, but to wish death is harsh. I hate the fact that the Kelly's was put in this situation. I hate that these boys acted out in an inappriate manner. They should be punished for their actions, but to wish death is cruel. AND IF YOU ARE TIRED OF HEARING ABOUT THE ISSUE OF BLACK AND ANY OTHER RACE OF DISCRIMINATING FACTORS look in side yourself and see how you act towards another race. I have friends of all ethnicities. The bottom line is right is right and wrong is wrong no matter what color or where you came from. The color people should be talking about is green! As long as there are people with money and people without there will be crime. Since America is heading into an extended period of high unemployment we should expect more crime to result. For thirty years we have seen a shift in the distribution of wealth. Good paying middle class jobs have and will continue to disappear. We better get used to the idea of the rich and the poor because the middle class is shrinking. Expect this to be the tip of the iceberg. We have plenty of countries as examples of life with a wide disparity in wealth. It's our future. America does not have a god given right to a strong economy forever. Get real people.

A victim mentality is no way out of ANY situation in life. It may give you false justification for your actions (or lack of), but you're kidding yourself if you think social or individual progress can be made, when one continually relies on a crutch. And yes, I do walk the walk. I have many friends in the AA or BA Community that I have great respect for, and agree that things are as tough as ever, but the continued victim mentality that cements the situation in place is frankly pitiful & nauseating. Past time to move forward!

I have to agree that the victim mentality is a self fulfilling prophesy. You will fail if you believe you're beaten before you even try. You will also be beaten if/when you listen to others around you who have failed. We used to call it the "Blue Crab Syndrome". Just like a bushel of crabs when one is almost out of the basket, there are others ready to grab and bring them back down. It takes considerable self discipline to rise above a poverty mentality, but it can be done. Been there, done that, as have several of my friends and we come in all colors.

Prayers for Mr. and Mrs. Kelly. I wish you both a speedy recovery. It breaks my heart to see our elderly population harmed. I was raised from a single Mom after my father died at a very young age. The world wide excuse people are using about their childhood is over. Life is what you make of it. The fact of people not respecting others especially our elderly is heart breakening. These so called thugs should have been out some where at work. People are put on welfare, food stamps, wick and subsidizing at an early age and never taught to work. If any race whether it be black, mexican, Native American, Chinese, white or other want to be respected get off your sorry @$$ and go to work. Remember you get out of life what you put into it. I can not understand for the life of me, why race has to be brought up or considered every time something happens. This drives me crazy! We are each responsible for our decisions on a daily basis, period. These boys made a decision to do what they did. They planned out what they were going to do and how, even had a get away driver. I do not believe their decision to act was based on their culture or upbringing. That is a cop out to blame others for your actions.

You can fill out a job application just as i can. You have been taught what you beleive by your family and friends. So that is all you know. His first court appearance is scheduled for July 15, according to a release from the Moore County Sheriff's Office. Three people, including one suspect, were injured during an armed robbery that happened at approximately 10:30 p.m. Monday at the Short Stop convenient store on U.S. Highway 1.

It is taking him a lot longer, but that is making him a stonger person. These boys had the same opportunity as he did.

Until any of the people on this site if force to experience just one week in the Black nieghborhoods, there should not be any comments made to put down ones parenting or economic status. You said you will always make more money then say "women" doing the same job (and why? just because you are born white and male, its a fact), Thats why i said that. Everyone is paid different at a job based on hire date, eduacation, and the job you do. If you know something i don't please teach me. According to this link, had Mr. Kelly concealed a shotgun in his vehicle and was detained for a traffic stop and his gun was discovered by a member of law enforcement, he could have been charged. Now with that said, the decision would have been left to an officers discretion. "with time on-duty in Law Enforcement acquires knowledge; with experience comes discretion". A quote I used many times before.

He is running for office because he believes in a cause (transparency in government, just to name one). He has a wealth of life experience and knows Moore County inside and out. I wish for both Gracie and Gene a speedy recovery. I have known them most of my life and my husband and I went to school with their grandson Chris. They are the nicest people anyone could ever meet. I hate that this happened to them. Gracie greets me every morning and ask me what I have planned for the day, Often I see Gene greeting me also with the same bright smile. I also know the family of one of the men that was captured. I know that they are in shock as well. He did not grow up in the best neighborhood, but his grandparents (whom he lived with) worked very hard to provide him with as many good oppurtunities as possible. He comes from a Christian home with good moral values, so the blame can not be put on those who raised him, but on the decisions that he decided to make as an adult. Yes the men that did this should all be punished, however unless you know for a fact where these guys were raised and how they were raised, you should just assume it was their "upbringing", parenting, and environment that made them do this horrible act. Many of you are punishing their families with your words, because of your assumptions not because you actually know them. This truly is a no win situation. Mr and mrs. Kelly will see these images for the rest of their lives when they close their eyes. All of the men involved have ruined their lives forever, because of an extremely bad choice, their families will deal with all of the critisim and fingers being pointed at them and questions of where did they go wrong, and the community will always feel a little unsafe and untrusting now, because many thought it could never happen there. I pray for all the parties involved and my love and special prayers go out to Mr and Mrs. Kelly.

1. NO, he will not be charged with assault with a deadly weapon - a person is legally allowed by law to use deadly force when their life or someone else's life is in danger.
2. You asked about the carrying a concealed weapon correct? What makes you think he was carrying it concealed? The article said that he "got the weapon from his vehicle" where did it say that it was concealed? You can legally carry a loaded firearm as long as it is stored in a visable place (hence, not concealed).
3. NO, Mrs. Kelly won't be charged with obstructing - ARE YOU KIDDING ME?! When would you have wanted her to call 911, while a gun was in her face, or when she was being used as a human shield?!?!
I am not mad at you since you are simply posting questions, but for anyone who actually believes that the Kellys did anything wrong - there are some berries that you can go "gather" for me, while I am out "hunting" with the rest of the people who keep this country great :)

It's easy for people to sit at home and make armchair judgments, but they would think differently if it was they who went to pick up their wife of decades (I don't know actually how long they've been married) and saw four men with a gun to her face. Regardless of what the law says, I'd put three rounds center-mass in each of them and then finish it off with a flame-thrower.

It is sad that most of you are making judgments based on race. What about all the other people of the same race that live proud, respectable lives? The ones that do not "gang bang", steal, use drugs, curse, know who their "baby daddy" is because he lives with them? All blacks are not the same as with ANY race. No two people are alike, so how can you classify all by one's mistake? @Well_U_Asked, I am sorry you and your children had a rough point in your life. However, to judge all blacks because you met some bad ones is just wrong. As a young girl, because of my father's position and status, we had members of the KKK burn a cross in our back yard. That would have been the perfect opportunity for my parents to teach me to hate other races. However, they did not. They taught me to not make judgment against others. That everyone does not share the same views. I am married, husband defends our country. Never been in trouble with the law, kids are honor roll students. Still I have been ignored many times while waiting to receive service. I have experienced being called racial slurs for no reason other than my skin color. I have been chased out of a store accused of stealing pillows of all things, because the clerk did not have a bag large enough to place them into. Seriously, the list could go on of pointless, unfair, and unjust encounters. I am sure we all have had them to some degree. I was always taught to respect others and I still continue to this day to do so. So to reiterate my point, not everyone behaves the same way, black, white, or any other race.

Go back to my post and perhaps you might just see the humor? What would the possible outcome been if Mr. Kelly didn't have his shotgun? They both possibly could have been killed and thank God that didn't happen. Mr. Kelly as well as any person who would have encountered that situation possibly would have carried out his same actions. Who knows? Only if they had a firearm in their vehicle. I do know that if one is stopped in this county with a shotgun not in the back window of their truck in full display on a gun rake, they could be charged with carrying a concealed weapon.

you can have it in your lap you can have it in the floorboard you can have it on the dashboard you can have it laying accross the passenger/back seat etc...

I don't run because I don't want to. I am not always on here bad mouthing everyone in the county because they don't do what I want them to. When you grow up and start working you will figure out that if you are going to have anything you are going to have debt. I never said I was totally in agreement with the jail issue I said I had some issues and I would have liked for it to have been put up for a vote. I also said I had respect for Toda because of his experience and knowledge but if he knows anything about politics he knows that your mouth will cost him more votes and he can talk up. Believe it or not junior I have alot of experience myself and not just in LE but also in politics. I also know that alot of political people are reading this info or I am showing it to them and they also agree you will do him alot of damage. I don't fight with bi-polar children and like I said before especially from behind a computer. I hope and so do many others that you keep talking because as long as you do Jimmy Melton and no other county commisioner is going to squirm or lose a minutes sleep about a write in canidate that you support. Toda can make some good points about some key issues and then you write something that makes no sense and shows you immaturity and age. That action by you takes the message out of what he spent awhile to post. Believe it or not but if Toda hires a good manager for his election that person will tell him alot of what I told you here. To my knowledge the Trail of Tears refers to various routes that were used to relocate eastern bands of Native Americans, (Cherokee, Seminole, Creek, and others), to reservations in Oklahoma. None of these trails went through Arizona to get to Oklahoma. What trail are you referring to?

Hasn't anyone besides me (hey, Toda, maybe you do) lived here long enough to remember what happened at the 66 station in Hillcrest when the perp was injured during an attempted robbery ? It is not out of the realm of possibility for law enforcement and the justice system to wrongfully hold the true victims (the Kellys) responsible for injuries sustained by their assailants during the commission of a crime ?? I hope this does not happen AGAIN in this county !!

I believe that the "suspects" were truly perpetrators caught in the commission of a violent crime -- in my feeble little mind they don't deserve the label of suspect. I also believe that there reaction was more akin to retaliation than defense of themselves.
The justice system failed these young men and the community, as a whole, by not redirecting their lives earlier upon the commission of multiple crimes.

it doesn't say if Sineath was convicted of assault for shooting an unarmed fleeing man in the back.

Interesting as the first shot to be fired was from the outside into the building and at that point the suspects then defended themselves with firing back. Wonder if the wound suffered by the wife was fired from her husbands gun? I guess the suspects had the right to defend themselves at that point (everyone is arguing that anyone/everyone has the right to defend themselves, so I am guessing that would be the suspects as well)? I guess it is possible...
Is it possible for anyone to be more clueless? Defend themselves LOL They should be charged with a capital crime. Attempting to murder their victims should be a capital offense. Just because they are bad shots does not mean that they are less dangerous to society. At worst they need to be locked up for life.

Dusty ~ I remember that very well. I didn't keep up with actions of the court after it happen.
Do you recall a case where a store owner was having regular breakends at his business, and set up and aimed a shotgun at the front door where the perps were entering the store. When they entered the store, they entered the store through that door; the door knob was attached to the trigger using a pull string and subsequently he was shot and seriously injured. If my mind serves me well, the person breaking into the business ended up owning the store through a law suit. I couldn't find that specific case...it didn't happen here in Moore County. The court transcript would be an interesting read.

Drazil65 ... She (Gracie) did not always work that shift. She use to work 1st shift for as long as I could remember. But When The store was purchased from David Ragsdale the new owners then started making the employees shortly after that work off shifts even if that was not your normal shift. The employees that got the day shift normally were the ones who were in management / assistant management. Normally every night also there is a sheriff at that store near closing time just in case things like this is to happen.

Toda: the "trap gun" cases, wherever they're from, are classic ones studied in most criminal and tort law textbooks. The basic principle is this: you're allowed to use deadly force to defend your life or, in some cases, that of another. A booby trap--gun, spike pit, or IED-- doesn't come close to meeting that standard.
There are quite a few bloodthirsty Charles Bronson wannabes who think you should be able to kill someone for stealing your car or your silverware or 20 bucks, even if it's not your 20 bucks.
Fortunately, the law places a higher value on human life than that.

It seems like every time I read an article on here someone changes it to a race topic. It could be about a dog fashion show and someone is going to say it's racist.
I don't care if the boys who did this were purple with pretty pink polka dots. What they did was wrong. It was a horrible crime that I'm sure will have an equal punishment.

95% of the people on here are only concerned with the race of the suspects. Who cares? They put down the entire black community based on what others do. All blacks are not criminals, no matter what you have heard or read. I read so much hate in the pilot that it's a shame. You should all be happy that the suspects were caught and pray, as a community, the Kelly's recover.

Dusty, sorry, forgot that your roots run deep, too. Thanks for looking it up and sharing. My point was only this, that justice isn't always just. There are cosequences, legal and otherwise to your actions. The victims here will have scars from this, visible and not, long after the hullaballoo dies down. Being hailed a hero doesn't mean there won't be pain associated with decisions made no matter whether the actions taken were necessary or only perceived so. Being right doesn't mean there isn't suffering involved.

A tragic as this situation is, it bates the question why was this 60 year old man carrying a loaded shotgun in the back seat of his car? "Every American has the right to bear arms"? This is lunacy. Did the man have a cell phone? Did he first try to call the police for assistance? The "Dirty Harry" comments about this guy fail to realize that Clint's character was a highly trained police detective. It is very unlikely that any professional law enforcement officer would have randomly shot through the door in an effort to save a hostage. Especially when all were armed and the chances of losing the hostage were extremely high. Emotion was what got this guy and his wife shot. Had he played it cool and called in the professionals, maybe all they would have lost was a few bucks. There were lots of alternatives had the just thought for a moment. He could hidden behind his car for when they came out. He could have attempted to disable their car. He shoud have just called the police. I understand the man and the baby made it out okay. They gave up the wallet - cheap loss in the face of a life and death situation.

Some of the "speculations" here are interesting. It makes no difference the reason Mr Kelly had the gun in the car, but just the fact that he did. The other things like they would have gone on and done nothing to Mrs. Kelly if not for the shot fired by Mr Kelly....well, maybe so, maybe not. The facts still stand on what did happen. I'm sure there will be more facts presented as the investigation continues.

Suffice it to say that I have been in combat situations where it is only the "cool head" and strategy that has saved lives. I've also been in proximity situations where civilians were at risk in this country. The question as to whether Mr. Kelly had the right to have a loaded shotgun in his possession is in fact germane. The reaction of the man with the baby was appropriate as he saved his life and the life of his baby. The action of Mr. Kelly was what got he and his wife shot. Since the theives didn't shoot the man and child, one can presume their motivation was the cash. Leaving witnesses didn't seem to be an issue for them. They only fired when they were fired upon. As for someone who would prefer I rush in and put my wife in danger under the guise of "protection" (without thinking) I'm glad they're not related to me either - because at this point I'd be in critical condition and you'd have a bullet in your shoulder.

I think there is a law in NC that people convicted of a felony and serving time has their children(baby daddy) compensated by the state. Is anyone familiar with this law? If it is true, we have to pay 3 squares a day, medical, dental and now support for their children? I hope i am wrong!!! That's right and they were all commited by the same people and I'm sure Mr Kelly was running all those figures through his head while watching his wife get robbed by gunmen. Maybe he was thinking ahead having his shotgun in the car for just such an occassion.
But you know what just because some people are using hand guns to rob someone we should always assume they only mean well and would never actually use the guns. It is quite silly to think someone willing to rob someone at gunpoint would actually use it.

I can't believe that anyone would think Mr. Kelly did anything wrong. I know them personally and he was only trying to defend his wife, with a hunting rifle, by the way. I dare say if you drove up and your wife was being held at "gunpoint" you wouldn't do what you could to protect her. Would hate to be married to some of you.
Let's put the blame where it goes. These bums should have been at work themselves instead of taking what doesn't belong to them. So many people try to blame everyone else - well blame them for robbery and holding someone at gunpoint. Its a wander she didn't have a heartache and die right there. Since some above want to play armchair QB, lets look at the (more likely) potential headline if Mr Kelly had done nothing: Local Store robbed clerk, man and his child shot to death while clerk's husband watched. Suspects on the run.
Someone above also was shocked that this man had a "loaded" gun in his truck, well an unloaded gun may as well be a bat. A bat at a gunfight will lose every time.

During the commission of a crime these punks had NO RIGHT to self defense...doesn't matter how many shots were fired at them or who fired them! Any person, with or without a CCP, has the right in N.C. to use deadly force to aid another human being. His shotgun was not a concealed weapon. My understanding is that his wife and the baby were not anywhere near the line of fire. Just some quick comments to clear up some possible mis-conceptions...that said, how do we know these pillars of society didn't mean to harm anyone?? Worldpro...his Jeep was parked right at the front door so how do you expect him to use a cellphone to call the police without their seeing him and possibly shooting him anyway?? And at that time his wife was NOT a hostage. And how was he going to disable their car when punk number four was in the car and probably armed?? And with all due respect to my LEO friends "When seconds count, the cops are only minutes away!" Yes, he took a risk but had he done nothing and these punks had shot his wife he would have to live the rest of his life with that!! Actually the MCSD got on the scene very quickly but these guys were gone by then. Their driver chickened out and left them to make a run for the swamp. There is no firm knowledge of what "might" have happened and I personally think that doing nothing is rarely an option. I can give you cases that have been right here in Moore County to back up what I say.
Having read all the comments I'm dismayed that we have so many people here in the Sandhills who were not there and didn't know about it until it hit the news but who have made statements without having any knowledge of what actually went on!! Is there a real problem with waiting for all the story before spouting off about how Mr. Kelly might have put people at risk?? I personally think that he did a great job with a single shot shotgun and I'd have preferred that he had a gun with more rounds and more power!!
And Dusty, the main difference between Libs and Cons is that when a Con doesn't like guns he simply doesn't buy one.....when a Lib doesn't like guns he doesn't want anyone to have one. I find it fascinating that the "party of the people" lumps all gun owners into the criminal pot.

You may learn in the future that one of the thugs came with hands up and said don't shoot, and Mr K told him to go on then. Well, I "heard" that one came back with a gun and shot Mr. K in the torso. IF that's true, how was this criminal defending himself when he could have just gone on and left the scene. And again, this is just hear-say. Let the facts come out before passing so much judgment and speculation. I personally know Mr & Mrs Kelly and they are fine people. I pray for their recovery. The robbers were in process of crimes and I am shocked at all the "what ifs" that many of coming up with. Let the truth and facts come out on what happened.

For the record, I have not once commented on specifically on Mr. Kelly. I hope he and his wife recover quickly. Both physically and emotionally.
My remarks have been consistent here and in other threads. I am just communicated my opinion regarding the ignorance of us all carrying guns and starting a gun fight in the name of self defense.
Someone breaks into your home, have at it. Blow 'em away. However, out in the street/public where other lives (not the bad guys) get impacted by your macho decision, well, it is just bad business. If you are going to play shoot 'em up cowboy, then you have to be willing to take responsibility for your actions. Kill or injury an innocent bystander then don't whine about going to jail yourself. You make a bad call, do the time, too. And, please don't use the excuse that you had to make split second decisions, because then you would be making my point. If you aren't capable of keeping your cool, you shouldn't be carrying.
And btw, not all conservatives or moderates have to be gun advocates so settle down on the "liberal" name calling.

has anyone seen the latest Supreme Court opinion? well in case you haven't basically they took the DC gun ban ruling one step further and said that the 2nd amendment applies to every US citizen(Baring felons, crazy folks, and in certain places) they also said that the "INtented for Militia" interpretation was B.S. hopefully we will be reading about more law abiding, gun carrying people like Mr. Kelly protecting themselves, their loved ones and their property in the future. I say God bless the Kellys and I pray that if he pulls through that Ed's Guns or some other 2nd Amendment lover will see fit to donate an automatic short barrelled shotgun and a case of buckshot to him. Heck, maybe a Tommy gun would be nice!!!
