The following criminal judgments have been rendered in Moore County Superior Court.

March 16, 2009

Anthony K. Amos, felony probation violation-out of county, sentence activated, 10 to 12 months in prison to run concurrent with sentence now serving in Buncombe County, work release allowed, comply with treatment order, and pay all monies owed.

Becci A. Bolen, two counts misdemeanor probation violation, sentence activated, modified to 30 days in prison to run at the expiration of each, credit for 26 days served, work release allowed and pay attorney fees.

Andrew A. Brown, felony probation violation, sentence activated, 18 to 22 months in prison, credit for 108 days served, work release allowed and comply with treatment order.

David Eustler, felony assault with deadly weapon on government official, 16 to 20 months in prison, suspended, 36 months supervised probation and three months intensive, comply with treatment order, do not associate with any persons or places identified by probation including Thr Pine Crest Inn, and comply with other conditions as directed by probation.

Jarvis Ferguson, two counts felony possession of a firearm by felon, voluntary dismissal; felony voluntary manslaughter, 77 to 102 months in prison, credit for 68 days served, pay $5,000 restitution, and attorney fees.

James E. Heaton, misdemeanor probation violation, sentence activated, 45 days in prison, credit for 24 days served, work release allowed and pay all outstanding fees owed.

Vicki D. Lankford, felony probation violation, sentence activated, for to six months in prison, work release allowed, comply with treatment order, pay $680 restitution, attorney fees, and court costs.

Travis L. Lovette, misdemeanor probation violation, pay all outstanding monies owed, and then terminate probation.

Christopher A. McNeill, felony probation violation, sentence activated, modified to six to eight months in prison, work release allowed, credit for 15 days served, and pay all outstanding monies owed.

James R. Richardson, felony probation violation, pay all outstanding monies owed then terminate probation.

Henry S. Tagalog, felony probation violation, sentence activated, six to eight months in prison, credit for two days served, work release allowed, and pay $733.50 restitution and attorney fees.

Michael D. Thomas, felony probation violation, sentence activated, four to five months in prison, credit for 35 days served, work release allowed and pay all monies owed.

Dawnette D. Bober, felony probation violation, sentence activated, six to eight months in prison, work release allowed, credit for 57 days served, comply with treatment order, and pay outstanding monies owed.

Avery B. Hockaday, three counts felony probation violation, amend judgment to 30 months for each count.

Patrick G. McMillan, misdemeanor probation violation, extend probation six months, attend treatment for alcoholism, and pay attorney fees.

Kramer W. Talley, felony probation violation, sentence activated, 10 to 12 months in prison, work release allowed, comply with treatment order and pay outstanding monies owed; felony probation violation-out of county, sentence activated, 29 to 44 months in prison to run concurrent with previous sentence, work release allowed and pay outstanding monies owed.

Asa M. Warf, misdemeanor probation violation, sentence activated and modified to 12 months in prison, work release allowed, credit for 31 days served, and pay all outstanding monies owed; misdemeanor probation violation, sentence activated, 45 days in prison, and same conditions apply.

Chauncey Y. Williams, felony probation violation, sentence activated, eight to 10 months in prison, work release allowed, comply with treatment order, curfew to be set by probation, pay money towards restitution, attorney fees, and comply with other conditions set by the court.

Leroy S. Womack, two counts felony possess with intent to sell or deliver cocaine, voluntary dismissal; two counts felony sell cocaine, 13 to 16 months in prison, suspended, 36 months supervised probation and three months intensive, comply with treatment order, do not associate with persons or places identified by probation and do not go on premises of Tommy's Grocery, pay $80 to drug fund and attorney fees; two counts felony deliver cocaine, voluntary dismissal.

Karen T. Zenns, three counts felony probation violation, all monies have been paid, release from prison and terminate probation.

Travier L. Barrett, felony first-degree kidnapping, voluntary dismissal; felony robbery with dangerous weapon, 51 to 71 months in prison, pay $795 restitution, attorney fees and court costs; felony robbery with dangerous weapon, voluntary dismissal.

Andrew A. Brown, felony fail to register as sex offender consolidated with felony larceny, 21 to 26 months in prison, work release allowed, credit for 108 days served, comply with treatment order, pay $313 restitution and credit for any payments made, attorney fees and court costs; felony possess stolen goods/property, voluntary dismissal.

Herman A. Cagle, misdemeanor probation violation, sentence activated, modified to 21 days in jail, credit for time served and pay attorney fees.

Bryce M. Clark, felony first-degree kidnapping, voluntary dismissal; felony robbery with dangerous weapon, 51 to 71 months in prison, credit for 142 days served, pay all fees and court costs; felony robbery with dangerous weapon, voluntary dismissal.

Nazario Deloya, felony indecent liberties with child, voluntary dismissal; misdemeanor assault on a female, 75 days in prison, suspended, 12 months unsupervised probation, 100 hours community service within 180 days, remit fee and report for community service within 48 hours, pay court costs; misdemeanor contributing to delinquency of juvenile, voluntary dismissal.

Ryan A. Haire, misdemeanor probation violation, paid $1,108.50 in fees, probation terminated.

Michael L. Johnson, felony embezzlement, eight to 10 months in prison, suspended, 18 months supervised probation, serve 20 days in jail and credit for time served, do not associate with persons or places identified by probation, pay $1,192.58 restitution to Richmond Rentals, pay attorney fees, court costs and upon compliance transfer probation to county of residence; misdemeanor financial card fraud, voluntary dismissal.

James D. Jones, misdemeanor probation violation, sentence activated and modified to 100 days in prison, work release allowed, credit for 15 days served, comply with treatment order, pay attorney fees and case appealed.
