However, it is my understanding that the 5th applies only to answers, if given, which may implicate you in a crime...in which case the witness may plead the 5th and remain silent. I may be wrong about this, but I believe I am correct. That said, when a senior IRS official like Lerner tells Congress in advance that she will invoke her 5th amendment rights, doesn't that tend to imply that criminal activity may have taken place? To me, Lerner's announcement may take the IRS scandal to a whole new level. Dark times indeed. Cheers!
